By using The Game Knot website, you approve that you have read, understood, and agree to be bound by these Terms.

Services

The Game Knot website is owned and operated by Matthew McCarthy. On The Game Knot, we provide video game news, video game reviews, and editorial/personal essay articles on general media. We also provide screenshots (with a screenshot credit to Matthew McCarthy) and pictures (with a general credit to Matthew McCarthy) to highlight visuals of video game news, to visualize elements from a video game(s) or other fictional media, or for providing a cover photo for articles.

Additionally, The Game Knot provides a subscription service to be alerted of articles and a comment system for users to share their thoughts. All of our Services are free of charge.

Canadian Law

The Terms and Conditions listed here and any disputes and claims related to The Game Knot and its Services are governed by the Federal Laws of Canada and laws of the Province of Ontario applicable therein, without regard to conflicts of law provisions.

International and non-Ontario use

The Game Knot makes no representation that the articles and content are appropriate or available for use outside of Ontario. Accessing The Game Knot's Services is prohibited from territories where it is illegal to do so. You are responsible for complying with the local laws when accessing The Game Knot Services outside of Ontario, as you would be doing so at your own initiative.

Account Information
Requirements to Make an Account

You must be at least thirteen (13) years old or of the legal age to make an account on The Game Knot and Wix. Legal age may vary, for example the legal age for individuals in European Jurisdiction is sixteen (16) years old. Accessing The Game Knot indicates your representation that you are thirteen years old or the proper age.

 

We are not responsible nor liable for any misrepresentation of your age. You are responsible for the accuracy of your Personal Information. 

 

Responsibilities of having an account

It is your responsibility to make sure the information and Personal Information you give to The Game Knot for subscriptions, filling out the contact form, and other such information (ex. profile pictures) is accurate and up to date.

It is also your responsibility to make sure your password is protected from unauthorized access. You will be held responsible for any activity under your account.

Reviews published by The Game Knot with graphic content for Mature Audiences (17+) will be given a warning near the beginning of the post before the review portion of a Review of graphic content. It is the responsibility of Users under the age of 17 to follow these warnings. Other articles, such as News and Personal Essays, will sometimes link to External Websites that may not be for Users under the age of 17-years-old, these External Websites are subject to their own age barrier. However, The Game Knot will give a warning for linked External Websites at its own discretion, such as if the age barrier is not present when The Game Knot feels Users should be alerted of potentially mature content.

By using The Game Knot Services, you agree that The Game Knot shall not be responsible for any Content, the consequences of any action that any person or you take or fail to take based on any material your or any person's reliance on The Game Knot's material, whether complete, current, or correct, incomplete, incorrect, non-current, or otherwise due to your use of the Services The Game Knot offers.​​

 

User Content

The Game Knot is not responsible for any information, text, data, software, music, comments, photographs, sound, messages, or other materials publicly posted or transmitted, publicly or privately, to The Game Knot through their social media(s) or website by you. This is not to be confused with information The Game Knot collects, this only refers to information and materials you choose to share.

If you post, upload, email, transmit or otherwise make such material available by using The Game Knot Services, you are entirely responsible for such material. We also do not guarantee the accuracy, quality, or integrity of such material. Under no circumstances will The Game Knot be liable in any way for any materials. This includes damages caused by sharing or viewing the materials and errors in any of the materials.

Termination of an account

We may temporarily or permanently delete or suspend your access to The Game Knot without notice and liability for any reason if you violate any of these Terms or any laws and regulations. You can discontinue your subscription at any time.

When making an account for The Game Knot, as a condition of use, you promise to not do anything that is prohibited in these Terms and Conditions or in the list below, the list being actions that can cause termination of your account, whether emailed, posted, uploaded, transmitted, distributed, published, linked to or otherwise: 
 

• Any material that incites hate, violence, or discrimination towards any group

• Material that is harmful, threating, torturous, pornographic, invasive of another's privacy, libelous, lawful, encourages criminal behaviour, violates any law, defamatory, vulgar, gives rise to civil liability, obscene, or is otherwise objectionable

• Material you do not have the right to make available under a contractual relationship or under any law 

• Material that contains any misrepresentations or falsehoods or create an impression that you are aware is misleading, deceptive, or incorrect 

• Material that harms minors in any way 

• Material that is or contains solicitations for business, junk mail, chain letters, promotional materials, unauthorized or unsolicited advertising, pyramid schemes, spam, or any other form of solicitation

• Material that infringes any trademark, patent, trade secret, copyright, privacy rights, or other proprietary rights of any party

• Material that contains viruses (ex. software) or any other computer files, code, or programs designed to destroy, limit, or interrupt functionality of any computer, computer software, telecommunications equipment, hardware, or data on The Game Knot website or data of any viewers of users of The Game Knot website or that compromises a user's privacy

• Perpetrating any fraud

• Publishing or distributing any obscene or defamatory material

• Impersonating another person

• Spoiling fictional media (exception: if the spoilers are in the comments section of a Spoiler Review, those are fine)

• Collecting or storing Personal Information or personal data of users or visitors on The Game Knot website

• Licensing, renting, assigning, transferring, selling, leasing, hosting, or otherwise commercially exploiting The Game Knot website

• Registering for The Game Knot Services on behalf of a group or corporate entity

• Decompiling, disassembling, making derivative works of modifying, reverse compiling, reverse engineering or translating any software part of The Game Knot website, except to the extent the foregoing restrictions are expressly prohibited by applicable law​

• Attempting to interfere with the proper working of The Game Knot's Services or any activities conducted on The Game Knot's Services 

• Using automated or manual devices, software, or other process to "spider" or "crawl" any page of the Services

• Bypassing one or more measures The Game Knot may use to restrict or prevent access to the Services, computer systems, networks, or other accounts connected to the Services

Intellectual Property 

The Game Knot logo and brand name, and all articles on The Game Knot are the Intellectual Property of Matthew McCarthy. 

​

The font used in The Game Knot logo is Balsamiq Sans, the Bold variation, which was designed by Michael Angeles. The Game Knot does not own the Balsamiq Sans font and its variations, however, its usage for The Game Knot logo is protected under the Open Font License (OFL). 

​

Retention of right to change offering 

We may, without prior notice; change the Services (ex. what articles we offer), create limits for the Services, or temporarily/permanently suspend The Game Knot's Services. We may permanently or temporarily terminate or suspend access to the Services without notice and liability for any reason, or for no reason.

Indemnification

Indemnification is compensation for any incurred loss, hurt, or damage. You agree to indemnify The Game Knot and Matthew McCarthy, The Game Knot owner. and hold us harmless against legal claims, attorneys' fees, and demands which may arise from your breach of these Terms and Conditions, your misuse or use of The Game Knot website, your conduct, or your actions. If needed or if we wish to, we will select our own legal counsel and may participate in our own defense.

Liability

The Game Knot is not liable for any damages that may occur when using The Game Knot website, to the maximum extent permitted by applicable law. These damages we are not liable for include indirect, special, punitive, incidental, consequential and exemplary damages, including without limitation, damages for loss of goodwill, use, loss of profits, data, or other intangible losses arising out of or relating to the use of, inability to use, the Services.

Right to change terms 

The Game Knot reserves the right to change these terms at our sole discretion from time to time. Any changes made to the Terms will be listed in the Website Updates page of The Game Knot. Your continued use of The Game Knot's Services after such a change constitutes your acceptance of the new Terms. Please do not continue to use or access The Game Knot if you do not agree with these Terms or future versions of these Terms.

Data Loss 

We are not responsible for the security of your Account. Your use of The Game Knot is at your own risk.

Reverse Engineering and Security

You may not reverse engineer or attempt to reverse engineer, or disassemble any code from or on The Game Knot. You may also not violate the security of The Game Knot through any unauthorized access, circumvention of encryption, or other security tools, data mining, or interference to any user, network, or host.
